Coach Inc sees weakness in North America; two more executives leave

By Phil Wahba

(Reuters) - Coach Inc on Tuesday again reported soft sales at its North American stores as it continued to face tough competition for handbag shoppers, and the leather goods maker announced the departures of two more executives.

Shares of New York-based Coach, which is known for its Poppy handbags, fell 6.2 percent to $54.25 in premarket trading.

Overall revenue rose 5.8 percent to $1.22 billion in the fourth quarter ended June 29, helped by gains it its men's merchandise and in China.

But sales at its own stores open at least a year fell 1.7 percent in North America, where Coach is competing with fast-growing brands like Michael Kors Holdings Ltd and Fifth & Pacific Cos Inc's kate spade.

Coach's decline stemmed from weak sales in its bread-and-butter business - women's handbags. This was the second drop in North American comparable sales in the last three quarters.

"They have lost some market share, no question about it, especially among young, fashion-conscious shoppers," Edward Jones analyst Brian Yarbrough told Reuters.

Mike Tucci, the head of Coach's North America business is stepping down, as is Jerry Stritzke, its operations chief. Analysts had expected this, given that the two had been believed to be candidates to succeed longtime CEO Lew Frankfurt.

Victor Luis, who oversaw Coach's international expansion, takes the reins from Frankfurt in January.

Still, those departures, along with the previously announced exit of Reed Krakoff, the creative director behind Coach's torrid growth of recent years, come as the company is trying to reignite sales in North America by becoming a "head-to-toe" lifestyle brand offering more footwear and clothing.

"We agree there's a lot going on," Frankfurt said in an interview. But he disputed the notion all these changes were disruptive. "We have a seasoned group of Coach veterans taking on these roles."

Despite the weak North American results, there were some positive signs. Gross profit margin rose slightly, suggesting Coach has not had to discount much.

Francine Della Badia, who currently heads North America merchandising and is succeeding Tucci, said sales of handbags priced at $400 or more had improved. Earlier this year, Coach had been struggling to sell those pricier products.

Sales at department stores also ticked up.

Excluding the effect of currency fluctuations, international sales rose 17 percent, helped by a 35 percent jump in China.

Net income for the quarter fell to $221.3 million, or 78 cents per share, from $251.4 million, or 86 cents per share, a year earlier. Excluding some one-time items, Coach earned 89 cents per share, in line with Wall Street forecasts.

Unlikely snag for D.C. Circuit Court nominee: Abstinence sex ed

Cornelia Pillard, a Georgetown law professor who has been nominated by President Barack Obama to the U.S. Court of Appeals for the District of Columbia Circuit, is facing a campaign to tank her nomination from a group that boosts abstinence-only sex education for young people.

Pillard was questioned closely by Republicans during her first confirmation hearing in front of the Senate Judiciary Committee on Wednesday morning about an article she wrote in 1997 that suggested that abstinence-only sex education may violate the equal protection rights of women.

The federal government provides millions of dollars each year to fund abstinence-only sex education that tells young people not to have sex until marriage. The government also funds so-called comprehensive sex ed, which encourages the use of contraception.

"You were arguing that if a state decides to teach abstinence-only, that that decision by state and local officials in your judgment may well be unconstitutional and it is an appropriate role for a federal court to strike [it] down," Sen. Ted Cruz, R-Texas, said on Wednesday, after telling Pillard he had "concerns" about her nomination.

Pillard replied that she was an academic when she wrote the article and was "pushing boundaries" ? asking hypothetical questions about the law. She added that teaching abstinence in itself is not discriminatory, but that using sexual stereotypes in the curriculum may well be.

"Let me say first, I'm a mother," Pillard replied. "I have two teenage children ? one boy and one girl. If my children are being taught in sex education, I want both my children to be taught to say 'no,' not just my daughter. I want my son to be taught that, too. The article was very explicit in saying I don't see any constitutional objection ? to abstinence-only education that does not rely upon and promulgate sex stereotypes."

The law professor identified what she called problematic stereotypes in some sex ed curricula at the time, including statements such as "the girl may need to put the brakes on first to help the boy" and "women gauge their happiness and judge their success on their relationships. Men's happiness and success hinge on their accomplishments."

Pillard hypothesized that teaching these stereotypes using public funds "violates the constitutional bar against sex stereotyping." She wrote that sex education conservatives believe "females' chastity is more important than males'; responsibility for guarding chastity is assigned particularly to females; marriage is the only proper venue for sexual intimacy; men's sex drive and sexual satisfaction is privileged while women's is demonized or ignored; and childrearing is viewed as primarily women's responsibility."

The article has enraged abstinence-only advocates, who are asking senators to oppose Pillard's nomination. "I really believe she has deemed herself unfit for the position," Valerie Huber, the president of the National Abstinence Education Association, told Yahoo News. "Our classes very much promote sexual restraint among both young men and young women equally."

Pillard declined to comment on Huber's criticisms, citing the confirmation process.

While Pillard was questioned closely about the paper, Republicans on the committee also stressed that the D.C. court, which is considered to be the second must influential in the country, after the Supreme Court, does not need new judges because its caseload is lighter than some other appellate courts.

Cruz said he believes Obama's three recent nominations to the D.C. court are "an attempt by the administration to pack that court because the D.C. Circuit has been one of the few restraints on government power exercised by the Obama administration."

Obama also has nominated Patricia Ann Millett and Robert Leon Wilkins to fill empty seats on the court. He announced the three nominations in June, and warned Congress not to block a vote on his picks. "There is no reason aside from politics for Republicans to block these individuals from getting an up or down vote," Obama said at the time.

Sen. Chuck Grassley, a Republican from Iowa, has argued that the D.C. Circuit has too many judges, signaling that Republicans may move to block a vote on Pillard in the full Senate.

Obama's nominations are almost guaranteed to sail through the committee, which is Democrat-controlled.

Pillard worked for the solicitor general's office and the Justice Department under the Clinton administration before joining Georgetown's faculty.

Lyoness America Violating Pyramid, Ponzi, Business Opportunity ...

I was in Dallas a few months ago, and received an envelope with a document titled ?Notification of Lyoness America violation of Pyramid, Ponzi, Business Opportunity and Security Regulations. Even though this two page document came from a very well-known direct sales, MLM, Network Marketing expert, we waited and continued to research the regulations and what regulators have been doing to close down money schemes in the USA.

Editor?s Update: It was pointed out to me by Jack Weinzierl, that I stated Lyoness was based out of Australia. I should have stated Austria.

Currently the Financial Fraud Enforcement Task Force, is moving throughout the USA closing down and getting solid convictions and settlements for the consumers. If ?Lyoness is found to be a Pyramid or Ponzi, then you can bet the settlements will be in the multi-millions of dollars. Hopefully, it will not be another Zeek Rewards!

Financial Fraud Enforcement

The Financial Fraud Enforcement Task Force is made up of the?senior-level officials from the following federal departments, agencies and offices:

This type of collaboration between agencies may be the biggest in history and is driving the activity we are currently seeing. Sadly, short sellers, critics and many in the media have not yet figured out, that agencies like the FTC (Federal Trade Commission) is not going easy on network marketing companies. Instead they are using their resources to truly nail the?contrepreneurs ? (marketers who use hyped-up promises to sell business opportunities to people eager to be their own boss.) That term was first used by?Lesley Fair in the article titled:?Cracking down on contrepreneurs.

So, back to Lyoness?

Lyoness

?

So even though Lyoness?International have been around for 10 years, that doesn?t make it legal in the USA, and they may have to defend their compensation model if the alligations below are found to be true. This same issue has happened to US based companies who have gone into Great Britain, Austraila, China,?and other counties.

The following are links to other investigative?editorials which seems to strengthen the purported alligations I received. I pulled from BehindMLM, not because I always agree with Oz, but because I trust him to report the facts? And a little subjective opinion from time to time :)

Researchers from the National Institute of Allergy and Infectious Diseases (NIAID) provide the first proof of concept data showing that a monoclonal antibody can neutralize human norovirus. This research, which could one day lead to effective therapies against the virus, was published online ahead of print in the Journal of Virology.

"We initiated this work because there is presently no virus-specific treatment or vaccine to control the norovirus illness," says Kim Y. Green, a researcher on the study. "Our working hypothesis was that a highly specific norovirus antibody that binds to the outer surface of the virus particle might prevent the ability of the virus to infect susceptible host cells."

The team first isolated genes from chimpanzee immune cells encoding norovirus-specific antibodies. They then converted these into human-compatible full-length immunoglobulin molecules. They successfully tested two of the antibodies against norovirus infection in chimpanzees.

"An effective therapeutic antibody might be explored as both a treatment for norovirus gastroenteritis, and as a disease prevention strategy," says Green. "Consider a developing outbreak scenario in which food-handlers, healthcare workers, deployed military, or travelers could reduce risk of infection, incapacitation, and spread if a safe and inexpensive treatment is immediately available."

Norovirus causes roughly 20 million cases of acute diarrhea and vomiting annually in the US, alone, according to the US Centers for Disease Control and Prevention (CDC). While in most people, symptoms last a day or two, for those with impaired immune systems, and the young and the aged, norovirus can be life-threatening. It is responsible for an estimated 70,000 hospitalizations and 800 deaths annually, and roughly one in 15 Americans get the disease every year. It is unusually contagious, via the fecal-oral route. People who have had norovirus remain highly contagious for at least three days after symptoms abate.

Scientists call for protection of Canada's boreal forest

An international group of 23 biology and conservation scientists is calling on the provincial governments and Ottawa to forever prevent the development of at least 50 per cent of the boreal forest that spans the Canadian north.

The Boreal Conservation Science Panel, made up of scientific heavyweights from Canada, the United States, Australia and Great Britain, will present a paper on Monday at the world International Congress of Conservation Biology in Baltimore that says the boreal?s value as a carbon store, fresh water source, and wildlife habitat is crucial to global ecology.

More Related to this Story

Although 80 per cent of the boreal is intact, only 10 per cent of the 1.2 billion acres of forest, tundra, peat lands, rivers and lakes is protected. The new report, a copy of which was obtained by The Globe and Mail, says the ?rules and regulations for managing industrial extraction of resources in Canada?s boreal forest have not kept pace with the rapidly expanding footprint of industrial activities and plans.?

The boreal contains the world?s highest densities of terrestrial carbon stores, has the largest surface of fresh water, is the nesting place for billions of song birds, and is home to viable populations of animals like caribou, grizzly bear, lynx and wolf.

?The boreal forest overall has an overriding potential influence on the global climate, marine productivity, the wildlife in the case of birds that move across the entire hemisphere. So it actually has a huge influence on the rest of the world,? said Jeff Wells, the science and policy director for the Boreal Songbird Initiative and one of the authors of the report.

The science indicates that no less than half of the region should be protected from development, Dr. Wells said. ?The exact specifics as to how to parcel that out across different regions and so forth is beyond the scope of what we talked about in the report and obviously would need to be figured out by people working in those regions. But that is the basic overarching guidance.?

It is not the first pitch of this sort. Back in 2007, the International Boreal Conservation Campaign of the Pew Charitable Trusts also argued for expanding the protected area, saying it was one of the world?s five remaining regions that help preserve the global environmental balance.

The report says that, if past rates of forestry continue, an area roughly twice the size of Vancouver Island will be harvested in the boreal region over the next 10 years. Mining exploration is opening previously inaccessible lands to industrial use. And, although existing hydro projects have disrupted the seasonal flow of water over thousands of miles of rivers and streams, many large hydroelectric projects are under construction or consideration.

Jim Burpee, the president of the Canadian Electricity Association, said hydro companies are are committed to sustainable development of Canada?s environmental resources and ecosystems. ?Our position is to pursue strategies and activities that balance the needs of members, stakeholders and the communities where we operate,? Mr. Burpee said, ?while protecting and enhancing the natural resources that will be needed in the future.?

An agreement was signed in May, 2010, among 21 forestry companies and nine environmental groups that covers 72 million hectares of publicly owned boreal forest and commits the companies to the highest forestry management standards. But two of the environmental groups have pulled out, saying not enough was being done.

Dr. Wells said many companies have taken progressive stands on boreal conservation. ?There are great leaders,? he said. ?There are also laggards that are not trying to do as well as they could with those sustainability standards.?
